EXPERIENTAL Terms & Conditions

Documentation: Proper documentation relevant to your itinerary destinations, such as passports, visas, and inoculation certificates, remains each traveller’s responsibility. Travellers must ensure they have appropriate immunisations before any experience - please consult your health provider for advice.

Weeknd Merchants will provide guidance on required documentation, but travellers who do not meet advised requirements may be denied access to experiences. Valid passports are required for all international destinations. If a passport is required, its expiration date must be at least six (6) months following the return date of the planned experience. Each foreign country holds different views on past criminal offences - if you have a current or past offence, please contact that country directly for entry and exit requirements. Weeknd Merchants considers it an invasion of privacy for members of our staff to make such an inquiry, and these requirements remain the traveller’s responsibility.

Pricing: Price quotes are applicable to the date and time at which they are requested. Quotes in foreign currency are subject to fluctuations in exchange rates and international credit card issuer fees. Weeknd Merchants is not responsible for any increases due to supplier-imposed changes, government-imposed taxes/fees, or external economic factors. Please note that per our supplier contracts, we cannot offer a breakdown of pricing.

Weeknd Merchants possesses the capability to secure a wide range of experiential services, including bespoke accommodations and curated activities, at competitive rates. Our commitment is to offer these experiences to our clients at rates that align with prevailing market standards. Please note that a 50% deposit is required upon confirmation of your booking. This deposit is non-refundable as it is utilised to secure all relevant vendors and ensure the smooth execution of your experience.

Experiential Services and Responsibilities: It is recommended to confirm arrival times, schedules, and any specific requirements for your chosen experiences at least 72 hours prior to their commencement.  Weeknd Merchants will not assume responsibility for any changes or cancellations by service providers. Certain countries may require additional taxes or fees payable on-site. 

Advised arrival or preparation times are subject to change without notification. It is the clients' responsibility to stay informed about changes that may impact their plans. Relevant details can be obtained by consulting with service providers or confirming reservations directly.

Protection/Insurance: Protection and insurance are strongly recommended to safeguard your investment. Unless specifically noted, insurance is not included in the cost of the client’s program. Information about relevant insurances will be provided to you within a reasonable time frame after deposit, based on trip cost and components.

Special Requests: If you have specific requests, such as dietary preferences or special occasions, kindly inform us in writing at the time of booking. Please note that while we will do our utmost to accommodate your requests, we cannot guarantee their fulfilment unless we provide you with explicit confirmation. The inclusion of a special request on your confirmation invoice or other documentation does not constitute confirmation of its fulfilment and does not form part of a binding agreement between you and us.

If you or any member of your group has a medical condition or disability that might impact your planned experience, please inform us before confirming your booking so that we can assess the suitability of your chosen arrangements. In any case, it is essential to provide us with comprehensive written details of any such condition or disability at the time of booking.

Force Majeure: "Force Majeure" refers to any unforeseeable event that neither we nor our service provider(s) could have anticipated or prevented, despite exercising all reasonable care. This encompasses events such as war or the threat of war, terrorist activities or the threat thereof, civil unrest or disturbances, nuclear disasters, adverse weather conditions, border closures, technical malfunctions with machinery, transportation, or equipment, health hazards, epidemics, and all other circumstances and uncontrollable natural disasters. Unless explicitly stated otherwise in these Booking Conditions, we sincerely regret that we cannot assume liability or provide compensation in cases where the execution or timely execution of our obligations under our contract with you is hindered or you incur any damage or loss due to Force Majeure.

Additional Disclosure: Weeknd Merchants acts solely as a booking partners for disclosed principal service providers, including accommodations, curated experiences, and other related services.

Each of these service providers operates as an independent entity with its own management and is not subject to the control of Weeknd Merchants. Weeknd Merchants shall not be liable for any accident, injury, property damage, or personal loss to the client or those travelling with the client in connection with any services we have booked, including but not limited to acts of God, weather conditions, natural disasters, acts of governments or other authorities, wars, civil disturbances, riots, strikes, epidemics, acts of terrorism, breakdown in equipment, theft, delay, or cancellation or changes in schedules.

By availing of our services, you acknowledge and accept that cancellation policies, change fees, and penalties set by service providers apply to your bookings. If for any reason your payment is declined, reversed, or Weeknd Merchants is unable to receive payment for the services, you agree that this is a binding contract, and Weeknd Merchants will be entitled to recovery, including reasonable attorneys’ fees in connection with collection.

Governing Laws: This Agreement shall be governed by and construed in accordance with the laws of Malaysia, and you submit to the exclusive jurisdiction of the courts of Malaysia.
